Categories of Personal Data Subject to Processing For the provision of our services and to fulfill the purposes of processing outlined in this Privacy Notice, it is necessary for VITia to process the following categories of personal data: • Identification data; • Location data; • Contact data; • Sensitive data related to your past, present, or future health; • Authentication data.
Processing of Sensitive Personal Data We inform you that to fulfill the purposes stated in this Privacy Notice, VITia will collect and process the following sensitive personal data: • Medical history; • Current conditions; • Hereditary diseases; • Genetic information; • General health status; • Vital signs; • Medications taken (dosage, days); • Personal hygiene data; • Data about daily life care; • Data from cognitive mental exams; • Medical studies, treatments, or prescriptions;
Primary Purposes of Processing VITia will process your personal data for the following primary purposes: • To verify and confirm your identity; • To create a user profile within the Platform; • To grant you access to the Platform's Services; • To adequately follow up on medical treatment and provide tools to comply with it; • To allow the healthcare professional to contact you to improve adherence to the therapy prescribed by your treating doctor; • To receive phone calls from a psychologist for patient treatment follow-up as needed; • To create a “Patient Diary,” which will contain the digital clinical file; • To contact you to address questions, complaints, and comments; • To generate reports for your doctor and/or caregiver about your disease progression and provide timely interventions; • To fulfill obligations acquired with you according to the Platform’s Terms and Conditions of Use; • To comply with legally established obligations under applicable regulations. VITia will process your personal data based on the legal relationship we have with you derived from the Terms and Conditions.
Secondary Purposes of Processing If you consent, we will use your data for the following secondary purposes: • To send you personalized advertising, promotional, and/or informational content, including offers and promotions from VITia according to your interests and consumption preferences, as well as from other brands and/or trade names, including communications via emails, phone calls, text messages, and other physical and/or electronic means; • For third parties (laboratories, hospitals, or the pharmaceutical industry) to contact you and offer their products or services; • To provide and improve VITia’s services, as well as manage the use of the Platform; • To edit and publish testimonials about your experience on the Platform; • For statistical studies; These secondary purposes are based on your consent, meaning you can oppose or revoke your consent at any time. If you do not wish for your personal data to be processed for any or all of the additional purposes, you can notify us at datos.personales@vitiacare.com
Transfers Based on Article 37 of the LFPDPPP, VITia may transfer your personal data without requiring your consent in the following cases: • To doctors or health professionals you authorize and select on the Platform for the purpose of treating the user's condition. • To affiliated, subsidiary, and/or parent companies, whether national or international, that operate under the same internal policies regarding personal data protection for the purposes mentioned in this Privacy Notice; • To competent authorities in cases provided for by applicable regulations if we receive a mandatory compliance request. With your consent, VITia will transfer your personal data to the following third parties: • To family members or caregivers who have previously registered as VITia Users; • To public or private research centers for statistical or evaluation purposes regarding patient improvement; • To healthcare providers, hospitals, health centers, and pharmaceutical and/or biotechnology companies such as manufacturers of medical products with which VITia may have collaboration agreements or similar, so that these third parties can contact you and offer products, medications, or promotions. You may oppose any of these transfers by contacting us at datos.personales@vitiacare.com
Relationship with the Healthcare Professional Users expressly accept that the doctors they authorize to be their doctors on the Platform have access to the data provided by users to VITia, so professionals can monitor and follow up on users, as well as give advice deemed appropriate by the doctors during the period each user decides. The healthcare professional authorized by the patient may only use the data of the user who selected them for monitoring and supervision of the user and to provide advice deemed appropriate during the period the user decides. The user can at any time add or remove doctors or other users (family members or caregivers) as they see fit.
Means to Exercise Your Personal Data Protection Rights You or your legal representative can exercise any of the rights of access, rectification, cancellation, or opposition (hereinafter “ARCO Rights”), as well as revoke your consent for the processing of your personal data by sending an email to VITia at datos.personales@vitiacare.com, where your request will be handled in a timely manner. In your email, you should provide the following information: • Full name, address, and email to receive a response; • Documents proving your identity (copy of official ID), or in the case of your legal representative; • A clear and precise description of the personal data regarding which you wish to exercise any of the rights; • Any other element that facilitates the location of your personal data. If the provided information is incorrect or insufficient, or if the required documents are not attached, VITia, within five (5) business days following receipt of the request, may ask you to provide the necessary elements or documents to process it. You will have ten (10) business days to respond to the request from the day after you receive it. Failure to respond within this period will result in the request being considered as not submitted. VITia will inform you of the determination made within a maximum of twenty (20) business days from the date the request was received, so that, if appropriate, you can enforce it within fifteen (15) business days following the notification of the response.
Options and Means to Limit the Use or Disclosure of Your Personal Data You can limit the use or disclosure of your personal data by sending your request to datos.personales@vitiacare.com The requirements to prove your identity, as well as the procedure to handle your request, will be governed by the same criteria mentioned above. If your request is deemed appropriate, you will be registered in VITia's exclusion list.
Use of Cookies and/or Similar Tracking Technologies on the Platform VITia uses several technologies to enhance the efficiency of the Platform, including your experience while navigating the site. Cookies are small amounts of information stored in the browser used by each user so that the server can remember certain information for later use. This information allows us to identify you and save your personal preferences to provide a better browsing experience. Please note that you can disable, block, or adjust the use of cookies and other technologies by following the procedures of your internet browser. • Select the “settings” option or tools according to your browser • Choose the option to disable cookies • This process will disable cookies not only from our Platform but from your entire browser. • All our sites have an applicable cookie policy. The personal data that can be obtained through the use of these technologies includes: Identifiers, session usernames and passwords; region of the user; browser type; operating system type; date and time of session start and end; visited web pages; searches conducted, and reviewed advertisements. These technologies can be disabled by following the procedures of your internet browser.
Changes to the Privacy Notice VITia reserves the right, at its sole discretion, to change, modify, add, or remove parts of this Privacy Notice at any time. Due to legislative updates, internal policies, or new requirements for the provision or offering of our services, this Privacy Notice will be subject to changes or updates.
